These terms apply to your use of XPI CRM (the "service") and this website, operated by AI Vision ADS SRL, Splaiul Independentei 313B, Bucharest, Romania, Trade Register no. J2025/08/7555/4002, tax ID (CUI) 52901345, email adrian@minidigital.tech ("we", "us"). By creating an account or using the service you accept these terms. If you use the service for an organisation, you confirm you may accept them on its behalf.

1. The service. XPI CRM is a customer success CRM. The Free plan is available at no charge. The Enterprise plan adds services such as premium support and onboarding under a separate written agreement, which takes precedence where it differs from these terms.

2. Your account. Keep your login details safe and tell us about any unauthorised use. Workspace administrators control who can access their workspace and with which role.

3. Provided "as is". The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. We do not promise the service will be uninterrupted, error-free or secure, or that any score, forecast, alert or calculation is correct or complete. They are aids to your judgement, not advice.

4. Support. The Free plan includes community help only. Enterprise support is defined in your Enterprise agreement.

5. Limitation of liability. To the fullest extent permitted by law, AI Vision ADS SRL, its owners and contributors accept no liability for any indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue, profits, customers, goodwill or business opportunity, arising out of or in connection with the service or this website, even if told such loss was possible. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months before the claim, or EUR 100 if you use the Free plan. Nothing in these terms limits liability that cannot be limited by law (for example for fraud, or death or personal injury caused by negligence).

6. Your data. You keep all rights to the data you put into the service ("customer data"). You give us permission to host and process it only to provide the service. You are responsible for having a lawful basis to store personal data about your customers and contacts. Where we process personal data on your behalf, our Data Processing Agreement applies. You can export your data at any time and delete your workspace. You should keep your own backups.

7. Fair use. The Free plan is subject to fair use: up to 10 GB of files, 1,000,000 records and 60 API requests per minute per workspace. We may contact you, limit, or suspend use that harms the service or other users.

8. Acceptable use. Do not use the service to break the law, infringe rights, send spam, store malware or content you have no right to store, probe or attack systems, or interfere with other users.

9. Changes and ending. We may change, suspend or stop the Free plan or any feature. For material changes we will try to give at least 30 days' notice by email or in the app. You may stop using the service at any time. We may suspend or close accounts that breach these terms. After a workspace is closed we delete its data within 30 days, except where the law requires us to keep it.

10. Third-party services. Integrations you set up (webhooks, API clients) send data to services you choose; we are not responsible for them.

11. Intellectual property. The service and its content belong to us or our licensors. Feedback you give us may be used without obligation.

12. Indemnity. You will indemnify us against claims arising from your customer data, your use of the service in breach of these terms, or your breach of law.

13. Law and disputes. These terms are governed by the laws of Romania. The courts of Bucharest, Romania have jurisdiction, without affecting any mandatory rights you have as a consumer.
